EXECUTIVE SUMMARY AND STATEMENT OF REASONS

Issues

This Proposal, P266, is the fourth minor amendments omnibus to the Australia New Zealand Food Standards Code (the Code). It has been initiated to correct errors that raise issues of minor significance or complexity only, identified since adoption of the Code that were not included in the previous three related proposals. The proposed amendments are intended to correct minor errors such as inconsistencies, misspellings, grammatical errors including clarifications, omissions and to update certain items.

Food Standards Australia New Zealand (FSANZ) has previously prepared three minor omnibus Proposals (P245, P254 and P262) to correct errors that raise issues of minor significance or complexity only, in the Code. The Final Assessment reports for P245 and P254 were considered and agreed by the ANZFA Board in February 2002 and June 2002 respectively. The Final Assessment Report for P262 was considered and agreed by the FSANZ Board in October 2002.

Consultation

Under Section 36 of the Food Standards Australia New Zealand Act 1991 (FSANZ Act) the Authority has decided to omit one round of public consultation as it is satisfied that the Proposal raises issues of minor significance and complexity only, and that omitting to invite public consultation at the Initial Assessment stage would not have a significant adverse impact on the interests of concerned parties.

The FSANZ Board agreed to the Initial/Draft Assessment at its meeting of 5 December 2002 and public notice inviting submissions was given on 18 December 2002. The consultation period ended on 12 February 2003. A summary of submissions is at Attachment 2.

Five submissions were received in the consultation. Three submissions unreservedly supported the proposal. Two submissions requested changes to the proposed amendments to the proposed drafting of Standard 2.7.4 and Standard 1.2.4 subclause 8(7). Upon review slight alterations to the proposed draft amendments have been made in light of these submissions (see Sections 6.3.2 and 6.9.3 below for relevant details).
